Throughout these Terms, “Company”, “we”, “us”, and “our” refer to Devalika Decor.

1. ACCEPTANCE OF TERMS

By accessing, browsing, registering, or placing an order on this website, you agree to be legally bound by these Terms & Conditions.

If you do not agree, you must discontinue use immediately.

These Terms constitute a legally binding agreement under the Indian Contract Act, 1872.

2. ELIGIBILITY

By using this website, you confirm that:

  • You are at least 18 years of age.
  • You are legally competent to contract under applicable laws of India.
  • All information provided by you is true, accurate, and complete.

We reserve the right to cancel orders or suspend access if false information is provided.

3. ACCOUNT & INFORMATION ACCURACY

If you create an account or provide information:

  • You are responsible for maintaining confidentiality.
  • You agree to provide accurate billing and shipping details.
  • You are responsible for activities conducted under your account.

We shall not be liable for unauthorized use resulting from your failure to secure your information.

4. PRODUCT INFORMATION

  • All products listed are ready-stock items.
  • We make every effort to display accurate colors and descriptions.
  • However, actual product appearance may slightly vary due to screen resolution, lighting, or manufacturing variations.
  • Minor variations shall not be considered defects.

We reserve the right to modify product specifications without prior notice.

5. PRICING & BILLING

  • All prices are in Indian Rupees (INR).
  • Prices are inclusive/exclusive of GST as displayed.
  • We reserve the right to change prices without notice.
  • In case of pricing or typographical errors, we reserve the right to cancel the order and refund the amount.

The customer agrees to pay all applicable charges at checkout.

6. ORDER CONFIRMATION

An order is considered accepted only when:

  • Payment is successfully received (for prepaid orders), OR
  • COD order is confirmed via call/SMS/WhatsApp verification.

We reserve the right to:

  • Cancel high-risk or suspicious orders.
  • Cancel multiple bulk orders.
  • Refuse service at our sole discretion.
  • Request additional identity verification.

If a prepaid order is cancelled by us, a refund will be initiated to the original payment method.

7. PAYMENT TERMS

We accept:

  • UPI
  • Credit/Debit Cards
  • Net Banking
  • Cash on Delivery (eligible locations only)

Payments are processed via third-party secure payment gateways.

We are not responsible for:

  • Payment gateway downtime
  • Bank server failures
  • Transaction failures due to customer bank issues
  • Delays in refund caused by banks

If money is debited but order not confirmed, customers must first contact their bank before raising disputes.

Fraudulent chargebacks will be legally contested.

8. CASH ON DELIVERY (COD) TERMS

  • COD is available only for selected serviceable PIN codes.
  • COD orders may require telephonic or WhatsApp confirmation.
  • Repeated refusal of COD orders may result in permanent blacklisting.
  • Customers who refuse delivery without valid reason may be restricted from future purchases.
  • Shipping costs incurred due to refusal may be recovered or adjusted.

We reserve the right to disable COD for high-risk customers.

9. SHIPPING POLICY

  • We ship only within India.
  • Delivery timelines are estimates and not guaranteed.
  • Delays due to courier partners, weather, strikes, natural disasters, or government restrictions are beyond our control.
  • Risk transfers to the customer upon delivery confirmation by courier.

Incorrect address provided by the customer may result in additional charges.

10. 7-DAY RETURN POLICY

Customers may request return within 7 days of delivery, subject to:

  • Product must be unused.
  • Product must be in original packaging.
  • No damage caused by customer misuse.
  • Unboxing video may be mandatory for damage claims.
  • Return request must be submitted within 7 days.

We reserve the right to:

  • Reject returns failing inspection.
  • Deduct reverse shipping charges (if applicable).
  • Deny return for used/damaged products.

Refunds will be processed within 7–10 business days after successful inspection.

Original shipping charges may be non-refundable.

11. NON-RETURNABLE ITEMS

The following may not be eligible for return:

  • Used items
  • Items damaged by customer
  • Clearance/sale items (if marked final sale)
  • Customised products (if applicable in future)

12. FRAUD PREVENTION & CHARGEBACK POLICY

We actively monitor fraudulent activities including:

  • False damage claims
  • Unauthorized chargebacks
  • COD misuse
  • Policy abuse

In case of fraudulent chargebacks:

  • We reserve the right to submit evidence to payment gateways.
  • We may initiate civil recovery proceedings.
  • Customer accounts may be permanently suspended.

13. INTELLECTUAL PROPERTY RIGHTS

All content on this website including:

  • Brand name “Devalika Decor”
  • Logo
  • Product images
  • Designs
  • Graphics
  • Text content
  • Website layout

are proprietary property of Devalika Decor.

Any unauthorized reproduction, resale, copying, or commercial exploitation is strictly prohibited and may result in legal action.

14. MARKETING COMMUNICATION

By placing an order, you consent to receive:

  • Order-related communications
  • Transactional emails
  • WhatsApp updates

Promotional communication will only be sent in accordance with applicable laws and opt-out options will be provided.

15. AFFILIATE & INFLUENCER TERMS

Devalika Decor may operate affiliate/influencer programs.

We reserve the right to:

  • Modify commission structures
  • Reject fraudulent traffic
  • Withhold payments for policy violations
  • Terminate affiliate accounts without notice

Affiliates engaging in misleading promotion may face legal action.

16. DISCLAIMER OF WARRANTIES

All products are provided on an “as-is” basis.

We do not guarantee:

  • Continuous website availability
  • Error-free operation
  • That defects will always be corrected immediately

To the maximum extent permitted by law, we disclaim all implied warranties.

17. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

  • Our liability shall not exceed the purchase price of the product.
  • We shall not be liable for indirect, incidental, punitive, or consequential damages.
  • We are not liable for courier delays or third-party failures.

18. INDEMNIFICATION

You agree to indemnify and hold harmless Devalika Decor against:

  • Fraudulent claims
  • Chargeback abuse
  • Violation of these Terms
  • Misuse of products
  • Third-party claims arising from your actions

19. FORCE MAJEURE

We are not liable for failure to perform due to:

  • Natural disasters
  • Pandemic
  • War
  • Government restrictions
  • Courier strikes
  • Any event beyond reasonable control

20. GOVERNING LAW & JURISDICTION

These Terms are governed by the laws of India.

All disputes shall be subject to the exclusive jurisdiction of courts located in New Delhi, India.

We reserve the right to initiate arbitration proceedings under the Arbitration and Conciliation Act, 1996.

21. MODIFICATION OF TERMS

We reserve the right to update these Terms at any time without prior notice.

Continued use of the website constitutes acceptance of updated Terms.
